This is a comparative jurisprudential study that studies the meaning of "Necessity", linguistically and idiomatically. It clarifies its legitimacy, rules, kinds, and impact on jurisprudential rules. It also clarifies the meaning of "Need" and its impact on rules. Moreover, it clarifies the meaning of "Interest" and how to be judged in Shari’a. It reveals the provisions of armistices and reconciliations in Islamic jurisprudence in terms of definition, legality, conditions, and duration. Then, it clarifies how these provisions are to be applied on the armistices and reconciliations with the Nusayri regime.
The researcher concludes that it is possible to make an armistice with the Nusayri regime when necessity and need demand and for legal interests. It is not possible for any reason other than legal necessity and need or if it includes no benefit for Muslims. However, reconciliations with or getting under the control of the Nusayri regime are not possible at all even for necessity.
