Abstract

Magic is a reality and has an effect on the affected person. Some types of magic can cause illness or death, while others can cause separation between a person and their spouse. Experts in legal Ruqyah (spiritual healing) can diagnose a person affected by magic and identify its symptoms during Ruqyah sessions. Magic, in some forms, can affect marital life and the validity of the actions and contracts of the enchanted individual. Particularly, the effects of magic can intensify if left untreated.

Questions arise such as: Is it obligatory for the affected party to disclose their condition before marriage? What is the ruling on marriage influenced by magic, known as “love magic” (Sihr Al-Tawlah) it one is The spouses are affected by magic after marriage, does it impact the occurrence of divorce? Can the marriage be annulled due to the defect of magic? This Fiqh study aims to answer these questions and the new emerging issues accurately. It also classifies them jurisprudentially with the appropriate rulings, mentioning the views and evidences of the jurists and their methods of inference, leading to the most correct opinion on the matter.
