Abstract

 Islamic law (Sharia) has organized the provisions of crimes and punishment in the best way. It established the principles of justice and restrained the hands of corruption. Among the serious crimes it dealt with was the crime of banditry and corruption in society, which threatens the safety of people and devastates their lives, and its punishments were among the most severe of the legal punishments. The forms of this crime varied and developed, One of its modern forms was the spread of pathogens by many evil people. Contagion as a type of assault on groups, harming them, intimidating them, and disturbing their comfort, as what happened in the new Corona epidemic and before it in the case of HIV/AIDS and others, when cases of intentionally spreading the disease in society appeared publicly. Thus it was necessary to study these dangerous acts from the point of view Legitimacy, knowing its legal description, and do they fall within the concept of the stipulated crime of banditry? Then what punishments does the perpetrator deserve? This research aims to study the legal ruling on this issue and answer its questions.
